Article 1 Purpose

This Terms of Service (hereinafter referred to as “Terms”) is for the purpose of regulating matters related to the conditions of use and operation of the services provided by “SeaHerb” (hereinafter referred to as the “Site”).

 

Article 2 Definitions

The definitions of key terms used in these Terms are as follows:

  1. Member: Refers to the user who agrees to the terms of the Site, provides personal information, completes the membership registration, and enters into an usage agreement with the Site to use its services.
  2. Usage Agreement: Refers to the contract entered into between the Site and the Member concerning the use of the Site.
  3. Member ID (hereinafter referred to as “ID”): Refers to a unique combination of characters and numbers assigned to each Member for identification and use of the Member’s services.
  4. Password: Refers to the combination of characters and numbers selected by the Member to confirm their identity as the user with the corresponding ID and to protect the Member’s rights.
  5. Operator: Refers to the operator who operates the website by providing services.
  6. Termination: Refers to the cancellation of the usage agreement by the Member.

 

Article 3 Supplementary Provisions

The Operator may announce and notify separate operating policies if necessary, and in case of any overlap between these Terms and the operating policies, the operating policies shall take precedence.

 

Article 4 Conclusion of Usage Agreement

  1. The usage agreement is established through the approval of the Member’s application for membership registration by the Operator, based on the Member’s agreement to the contents of these Terms and their application for membership.
  2. Users who wish to use the service by registering as Members must read these Terms during the registration process and express their agreement by selecting “I agree.”

 

Article 5 Application for Service Use

  1. Users who wish to register as Members and use the Site’s services must provide the necessary information (user ID, password, nickname, etc.) requested by the Site.
  2. Members who provide false information during registration or register with untrue information shall not claim any rights related to the use of the Site and may be subject to legal penalties in accordance with applicable laws.

 

Article 6 Privacy Policy

The Site and the Operator do not store the password among the personal information provided during member registration, and this part is subject to the Site’s privacy policy. The Operator makes efforts to protect Member registration information, including personal information, in accordance with relevant laws and regulations regarding the protection of personal information.

Regarding the protection of Members’ personal information, the Operator complies with the personal information processing policy established by the Site. However, the Operator is not responsible for information exposure due to the Member’s own fault. In case the Member posts illegal content such as postings that hinder public order and morals or violate national security through the Service, the Operator may view the Member’s information and submit the data to the relevant agency upon request.

 

Article 7 Operator’s Duties

  1. The Operator shall make efforts to promptly process opinions or complaints submitted by Members if they are deemed legitimate. However, in cases where rapid processing is difficult due to personal circumstances, the Operator will make efforts to notify the Member later through announcements or by sending messages, emails, etc.
  2. The Operator shall make efforts to repair or restore the facility without delay if there is a failure or loss in the facility necessary for the provision of the service due to system maintenance, addition, replacement, malfunction, or malfunction. However, in cases where there are unavoidable reasons such as natural disasters or circumstances beyond the control of the Site or the Operator, the operation of the Site may be temporarily suspended.

 

Article 8 Member’s Obligations

  1. Members must comply with the matters stipulated in these Terms, the various regulations set by the Operator, announcements, and operating policies posted on the Site, as well as other relevant laws and regulations related to the Site’s business. Members must not engage in any acts that interfere with the business of the Site or damage the reputation of the Site.
  2. Members shall not transfer or donate their service usage rights, or any other status under the usage agreement, to a third party without the express consent of the Site, and shall not provide it as collateral.
  3. Members must exercise caution in managing their ID and password, and may not provide their ID to others without the consent of the Operator. Members are responsible for any consequences of their failure to manage their ID and password.
  4. Members shall not infringe upon the intellectual property rights or other rights of the Site, other Members, or third parties through the use of the service, and shall not engage in any acts that may cause damage to the rights or interests of others.
  5. Members must not use the service for any commercial purpose, including but not limited to advertising, without the express consent of the Site.
  6. Members must not engage in any activities that are objectively judged to be associated with crimes.
  7. Members may not collect, store, or disclose personal information of other Members without their consent.
  8. Members must not post or distribute content that violates laws and regulations or public order and morals on the Site.
  9. Members must comply with the Site’s rules and regulations, including these Terms, in relation to the use of the service, and must not engage in any acts that violate applicable laws and regulations.

 

Article 9 Service Usage Hours

  1. The service is normally available 24 hours a day, 365 days a year, unless there is a special interruption due to business or technical reasons. However, the Site may temporarily suspend the service at the time and date specified by the Site for regular system maintenance, addition, or replacement, and such scheduled interruptions will be notified in advance through the Site’s homepage.
  2. However, in the following cases, the Site may temporarily or permanently suspend the service without prior notice:
    – In case of urgent system maintenance, addition, replacement, malfunction, or malfunction that may cause system failure
    – In the event of a national emergency, power outage, force majeure, or other uncontrollable reasons
    – When a period telecommunications service provider as stipulated in the Telecommunications Business Act suspends the telecommunications service
    – In case of excessive use of the service that hinders normal service usage, and other cases that may disrupt normal service usage
  3. In case of service interruption as described in the preceding paragraph, the Site will notify the Member in advance through notices or other means. However, in cases where it is impossible to provide advance notice due to reasons beyond the Site’s control, the Site will provide subsequent notice.

 

Article 10 Termination of Service Usage

  1. If a Member wishes to terminate the usage agreement with the Site, the Member must apply for termination of registration online. In addition to terminating the usage agreement, separate procedures are required to terminate the usage agreement with the Site.
  2. Upon termination of the registration, the Site’s related programs provided to the Member on the Member management screen are automatically deleted, and the Operator will not be able to view the information of the termination applicant.

 

Article 11 Restrictions on Service Usage

Members must not engage in the following activities, and if they do, the Site may restrict the Member’s use of the service and take appropriate measures, including termination of the usage agreement or suspension of the service for a specified period:

  1. Providing false information during registration or updating information after registration
  2. Interfering with the use of the Site by others or stealing their information
  3. Impersonating the Site’s administrator, staff, or related personnel
  4. Infringing upon the personality rights or intellectual property rights of the Site, other Members, or third parties, or interfering with their work
  5. Using another Member’s ID without authorization
  6. Collecting, storing, or disclosing the personal information of other Members without their consent
  7. Engaging in objectively judged criminal activities
  8. Engaging in any other acts that violate relevant laws and regulations

 

Article 12 Management of Posts

  1. The responsibility for the management and operation of the Site’s posts and materials lies with the Operator. The Operator must continuously monitor and delete posts and materials that are deemed to be of poor quality or that violate the rules, and provide warnings to the Member who posted them when such posts and materials are discovered or reported.
  2. Members are responsible for their own posts on the Site, and must not post content that violates these Terms.
  3. If there is a corrective request from public institutions such as the Korea Communications Standards Commission regarding posts and materials, the Operator may delete or move posts without the Member’s consent.
  4. The criteria for determining inappropriate posts are as follows:
    – Content that seriously insults or damages the honor of other Members or third parties
    – Dissemination or linking to content that violates public order and morals or is illegal
    – Encouraging illegal duplication or hacking
    – Posting for commercial purposes
    – Content that is objectively determined to be associated with a crime
    – Infringement upon the intellectual property rights or other rights of other users or third parties
    – Other acts deemed to violate relevant laws and regulations
  5. The Site and the Operator may temporarily suspend (suspend transmission) the posting of posts upon request from a third party for reasons such as defamation or infringement of intellectual property rights related to the Member’s posted content. The Site and the Operator will follow the decision of the relevant agency, such as a lawsuit, agreement, or the decision of a relevant institution, if it arises from a dispute between the Member and the third party or between Members.

 

Article 13 Storage of Posts

If the Operator has to temporarily suspend the operation of the Site due to unavoidable circumstances, the Operator will make efforts to provide advance notice to Members and take all necessary measures to facilitate the transfer of posts.

 

Article 14 Copyright of Posts

  1. The copyright of posts posted within the Site belongs to the Member who posted them. The Site cannot use posts for commercial purposes without the Member’s consent, except for non-profit purposes and posting within the service.
  2. Members may not use information obtained through the service for commercial purposes, including but not limited to advertising.
  3. The Operator may delete, move, or refuse to register posts and content that are deemed to violate the criteria specified in Article 12 without prior notice.

 

Article 15 Compensation for Damages

  1. All civil and criminal liabilities arising from the use of this Site are primarily the responsibility of the Member.
  2. In cases where the Member incurs damages from the Site due to force majeure, the Member’s intent, or negligence, the Site shall not be liable for damages.

 

Article 16 Disclaimer

  1. The Operator shall not be held liable for any failure to obtain the benefits expected from the provision of the Site’s services or for any losses incurred from the use of the service, including but not limited to, damages caused by the selection or use of service data.
  2. The Operator shall be exempt from liability for any losses incurred due to the failure of the Site’s service infrastructure and the telecommunications services provided by other telecommunications service providers, except as otherwise provided in the Site’s Terms.
  3. The Operator shall not be responsible for any data, information, or content posted, transmitted, or distributed by Members or available through the service.
  4. The Operator shall not be held liable for any service disruption caused by the Member’s own fault.
  5. The Operator shall not be responsible for any disputes arising between Members, between Members and third parties, or any other activities (including data transmission, other community activities, etc.), both within and outside the service.
  6. The Operator shall not be liable for the truth, reliability, or accuracy of the content of posts and all data that Members can access through the service.
  7. In transactions, etc., between Members or between Members and third parties through the service as an intermediary, the Operator shall not be liable for any losses incurred.

 

Article 17 Miscellaneous

These Terms shall be effective from August 3, 2023.
